1. About TowingIreland.ie

TowingIreland.ie ("the Platform", "we", "us", "our") is an online heavy vehicle recovery request service operated in Ireland. The Platform allows users ("you", "the Customer") to submit recovery requests for heavy vehicles, which we review and arrange with independent recovery operators ("Recovery Operators").

TowingIreland.ie acts solely as an intermediary platform. We do not provide towing or vehicle recovery services ourselves, and we are not party to any contract formed between a Customer and a Recovery Operator.

Vehicles we cover

The Platform is for heavy vehicles only: vehicles with a gross vehicle weight (GVW) of at least 3,500kg and no more than 44,000kg, and at least 18 feet (approx. 5.5m) in length. This includes rigid trucks, HGVs, articulated lorries and tractor units, buses, coaches, tippers, specialist vehicles, plant and agricultural machinery, and motorhomes, horseboxes and trailers over 3,500kg. Cars, small vans, motorcycles and other vehicles outside this range are not covered, and requests for them will be declined.

2. Acceptance of Terms

By accessing or using TowingIreland.ie, you confirm that you:

• Are at least 18 years of age
• Have read, understood and agree to be bound by these Terms & Conditions
• Have read and agree to our Privacy Policy
• Are legally entitled to request recovery of the vehicle specified (for example as owner, operator, fleet manager or driver acting with authority)

3. The Service — What We Do and Don't Do

We do:

• Receive and review your recovery request, and pass the job details to a suitable Recovery Operator
• Communicate with you about your request through the Platform and by email
• Notify you when there is a reply or a quote for your request
• Pass your contact details to the Recovery Operator carrying out the job once you accept a quote

We do not:

• Employ, control, or supervise any Recovery Operator
• Guarantee that any Recovery Operator will respond to your request
• Guarantee the quality, safety, price, timing or conduct of any Recovery Operator
• Verify that every Recovery Operator holds valid insurance (though we endeavour to do so)
• Take any payment from Customers on behalf of Recovery Operators
• Guarantee response times or availability

4. Recovery Operators Are Independent Third Parties

All Recovery Operators used through TowingIreland.ie are independent businesses. They are not employees, agents, or representatives of TowingIreland.ie.

The contract for recovery services is formed directly between you and the Recovery Operator at the point you accept a quote. TowingIreland.ie is not a party to this contract and accepts no liability for its performance or non-performance.

You should satisfy yourself that any Recovery Operator you engage:

• Holds appropriate motor trade and public liability insurance
• Is appropriately licensed and registered
• Has agreed a clear price before commencement of any work

5. Limitation of Liability

To the fullest extent permitted by Irish and EU law, TowingIreland.ie, its operators, employees and agents shall not be liable for:

• Any damage to your vehicle caused by a Recovery Operator
• Any personal injury arising from the actions of a Recovery Operator
• Financial loss resulting from the conduct of a Recovery Operator
• Failure of a Recovery Operator to respond to or fulfil your request
• Delays, errors or interruptions in the Platform's service
• Loss of data due to technical failures beyond our reasonable control
• Any indirect, consequential or incidental loss arising from use of the Platform

Nothing in these Terms excludes liability for death or personal injury caused by our own negligence, fraud, or any other liability that cannot be excluded under Irish law.

6. Your Responsibilities

When using the Platform you agree to:

• Provide accurate and truthful information in your recovery request, including the vehicle’s gross vehicle weight, length and whether it is loaded. Inaccurate details may mean the wrong recovery equipment is sent and may lead to extra charges or the job being refused
• Be available and reachable at the contact details provided
• Not submit false, misleading or fraudulent requests
• Not use the Platform for any unlawful purpose
• Not attempt to circumvent the Platform by contacting Recovery Operators directly after initial introduction to avoid using TowingIreland.ie (for paid plans, if applicable in the future)
• Treat Recovery Operator representatives with respect in all communications
• Cancel any outstanding quotes promptly once you have accepted a quote or no longer need the service

7. Accuracy of Information

We endeavour to ensure the Platform operates correctly, but we make no warranty that it is error-free, uninterrupted or fit for any particular purpose. Quotes received through the Platform are provided by Recovery Operators and TowingIreland.ie takes no responsibility for their accuracy.

8. Acceptable Use

You must not use the Platform to:

• Submit requests for vehicles you do not own or have no authority to move
• Harass, threaten or abuse any Recovery Operator or other user
• Introduce malware, viruses or harmful code
• Scrape, copy or redistribute content from the Platform
• Attempt to gain unauthorised access to any part of the Platform

We reserve the right to suspend or terminate any account that breaches these Terms.

9. Intellectual Property

All content on TowingIreland.ie — including the design, code, text, logos and branding — is the intellectual property of TowingIreland.ie. You may not copy, reproduce or redistribute it without written permission.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Complaints

If you have a complaint about a Recovery Operator's service, you should contact the Recovery Operator directly in the first instance. If you wish to report serious misconduct to us (such as fraud or dangerous driving), you may contact us at comparemytow@gmail.com and we will look into it and, where appropriate, stop using that Recovery Operator.

For unresolved disputes you may contact the Competition and Consumer Protection Commission (CCPC) at ccpc.ie.

12. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes by email. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
